When it comes to recording like that, I would just fall back on the First Amendment and all the case law that we already have presented. You cannot trespass anything that the eyes can see while in public. So if you are in a public environment, And you're on your phone. I mean you got to look around and think about how many security cameras store cameras are already picking up what you're showing unless you're in a location that's private, like, let's say inside of a private business, somewhere that you do have a reasonable expectation of privacy, then it's not okay. By the law. But I do. I do see that there is a type of creepiness though to recording somebody else's private phone call whether it's legal or not.
