Henrik Hertzberg of the New Yorker is salivating over the possibility of a Justice Gore. But would President Obama even consider Al Gore for the open Supreme Court slot? No. Even Hertzberg admits ‘it ain’t gonna happen’.
Let me give you three reasons why…

First, Al Gore is too old. President Obama wants to appoint justices who will last decades on the court. He wants to have influence of the direction of this country long after he leaves office, as did George W. Bush. Obama will likely get at least two picks, but in case he doesn’t, he wants to make this first one count. Al Gore is over 60-years-old and he doesn’t have the longevity prospects (not to mention legal background) that the other candidates possess.
The second reason President Obama won’t consider Al Gore is because he’s a white male. While I’m hearing tons of buzz over the possibility of a Hispanic on the court or another female — or, even better, a Hispanic female. I’m hearing little to no push for a white bread pseudo-intellectual. And, strangely enough, I’m not seeing much desire for another black justice either.
Finally, Gore would never be considered for the justice position because he’s too mainstream. Sure, Al Gore is out in the wilderness on global warming, but he’s more of a centrist on most other political issues and often lands in company with moderate Democrats. The President wants someone more ‘progressive’ than Gore. Someone with ‘empathy’ (how that applies to the court, I’m not sure) and a history of siding with the left will get this position.
